The customer shall be granted one personal access to the Platform after conclusion of this Agreement, only for internal test purposes. Use for third parties is not permitted. The customer is in particular not entitled to pass on access data to the Platform and/or contents and/or parts/extracts from the Platform to third parties or to grant licenses to third parties.
The customer agrees to use the Platform, including related information and other content, at all times in compliance with the terms and conditions set forth in this Agreement and all applicable legal regulations.
Fraunhofer IPT reserves the right to block access for the customer in the event of any violation of the terms of use specified in this section.
IPT grants the customer a non-exclusive right of use to the Analysis Results only for internal evaluation purposes with regard to a collaboration with Fraunhofer IPT. The Analysis Results can be viewed on the platform, downloading is not possible.
Confidential Information provided under this Agreement is provided »AS IS«. The Disclosing Party does not represent or warrant that the Confidential Information it discloses is accurate, devoid of mistakes, free and clear of any third-party rights, complete and/or usable. In this respect, there will be no liability, except in the case of an intentional act or omission (Vorsatz).
The Contracting Parties agree that a breach of this Agreement by the Receiving Party may cause irreparable harm and damage for which monetary compensation will not be fully adequate, and the Disclosing Party will thus be entitled to seek injunctive relief, in addition to any other legal remedies.
